Terms and Conditions

Article 1 – Definitions

In these Terms and Conditions, the following terms shall have the following meanings:

  1. Supplementary agreement: an agreement under which the consumer acquires products, digital content, and/or services in connection with a distance contract, and these products, digital content, and/or services are supplied by the business or by a third party based on an arrangement between that third party and the business;
  2. Return period: the period during which the consumer may exercise their right of withdrawal;
  3. Consumer: a natural person who is not acting for purposes related to their trade, business, craft, or profession;
  4. Day: calendar day;
  5. Digital content: data produced and delivered in digital form;
  6. Perpetual agreement: an agreement for the regular supply of goods, services, and/or digital content over a specified period;
  7. Durable medium: any medium—including email—that enables the consumer or business to store information addressed personally to them in a way that allows for future reference or use for a period appropriate to the purpose, and that allows for the unaltered reproduction of the stored information;
  8. Right of Withdrawal: the consumer’s right to withdraw from the distance contract within the return period;
  9. Business: the natural or legal person that offers products, (access to) digital content, and/or services to consumers at a distance;
  10. Distance contract: a contract concluded between the business and the consumer within the framework of an organized system for the distance sale of products, digital content, and/or services, in which one or more means of distance communication are used exclusively or in part up to and including the conclusion of the contract;
  11. Model Withdrawal Form: the European Model Withdrawal Form included in Appendix I of these Terms and Conditions;
  12. Means of distance communication: a method that can be used to enter into a contract without the consumer and the business having to be physically present in the same location at the same time.

If the business’s activities are subject to a licensing system: the details of the regulatory authority.

If the entrepreneur practices a regulated profession:

  • the professional association or organization to which he belongs;
  • the professional title and the location within the EU or the European Economic Area where it was granted;
  • A reference to the professional rules applicable in the Netherlands and information on where and how these professional rules can be consulted.

Article 3 – Applicability

  1. These general terms and conditions apply to every offer made by the business and to every distance contract entered into between the business and the consumer.
  2. Before the distance contract is concluded, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, the business will indicate, prior to the conclusion of the contract, how the terms and conditions can be viewed and that they will be sent free of charge as soon as possible upon the consumer’s request.
  3. If the distance contract is concluded electronically, the text of these general terms and conditions may, notwithstanding the previous paragraph and prior to the conclusion of the contract, be made available to the consumer electronically in such a way that the consumer can easily store them on a durable medium. If this is not reasonably possible, it will be indicated before the contract is concluded where the general terms and conditions can be accessed electronically and that they will be sent to the consumer free of charge, electronically or by other means, upon request.
  4. If, in addition to these general terms and conditions, specific product or service terms and conditions also apply, the second and third paragraphs shall apply mutatis mutandis. In the event of conflicting terms and conditions, the consumer may always invoke the provision that is most favorable to him.
